In the United States, vaccine litigation is governed by the National Vaccine Injury Compensation Program (NVICP), which was established in 1986 as part of the National Childhood Vaccine Injury Act. The NVICP provides a no-fault alternative to traditional litigation for individuals who have suffered harm as a result of receiving a vaccine. This means negligence does not have to be proven by the injured party in order to receive compensation. The program is administered by the United States Department of Health and Human Services and is funded by a tax on each vaccine dose.
Under the NVICP, individuals who have suffered from a harmful condition as a result of receiving a vaccine can file a claim for compensation with the U.S. Court of Federal Claims. Some of the conditions connected to vaccine injuries include:

A claim must be filed within three years of the date of the vaccine-related injury or within two years of the date of death, if the vaccine-related injury resulted in death.
NVICP Compensation for Vaccine-Related Injuries
The NVICP provides compensation for a wide range of vaccine-related injuries, including injuries related to the administration of the vaccine, such as injection site reactions, as well as injuries related to the vaccine itself, such as Guillain-Barré syndrome. The NVICP also provides compensation for death that occurs as a result of a vaccine-related injury.

Individuals who have suffered from a vaccine injury, or the legal representatives of minors, disabled individuals, or individuals who passed away as a result of a covered vaccine administration, can file a claim. In order to be eligible to file a claim, the effects of the injury must meet one of the following criteria: 1) Lasting for more than six months, 2) Resulting in a hospital stay or surgery, or 3) Resulting in death.
Claims for compensation under the National Vaccine Injury Compensation Program established by Congress must be made within 36 months of the date of the first symptom of injury, the onset of injury, or the significant worsening of a pre-existing condition due to receiving a covered vaccine.
